1. OVERVIEW

Viralsound AB and its subsidiaries (collectively, “Viralsound,” “we,” “us,” “our”) respect your privacy and are committed to protecting the personal data we hold about you. Viralsound is a music promotion tool which enables artists to promote their music via TikTok creators. We refer to those users who promote music as “Creators” and those users who pay to promote their music as “Artists”. This Privacy Policy explains our practices with respect to personal data we collect and process about you. This includes information we collect through, or in association with, our website located at www.Viralsound.com, our services that we may offer from time to time via our website, our related social media sites (LinkedIn, Instagram, Facebook, TikTok and Twitter), or otherwise through your interactions with us (the website, our social media pages, and services, collectively, the “Services”).

By using any of our Services, whether by visiting our website or otherwise, and/or by voluntarily providing personal data to us, you acknowledge that you have read and understand the practices contained in this Privacy Policy.

2. COLLECTING AND USING YOUR PERSONAL DATA

a. Personal Data
While using our Services, we may ask you to provide us with certain information that identifies, describes or relates to you. Personal data may include, but is not limited to:
  1. identifiers such as a real name, email address, career role and social media account names
  2. postal address
  3. tiktok video data (only public information such as ID, duration, views, likes, share count and comments count)
  4. usage data
    Usage data may include information such as your device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Services that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

b. How we use your Personal Data
We strive to ensure that our Services can be as effective as possible. To do that, we collect and may use your personal data for the following business and commercial purposes:
  1. Developing, improving, operating, providing and maintaining our Services, processing or fulfilling campaigns and processing payments.
  2. To communicate with you by email and text about the Services, verifying your identity, responding to support inquiries or, sharing information about the Services.
  3. To manage your account: to manage your registration as a user of the Services. The personal data you provide can give you access to different functionalities of the Services that are available to you as a registered user.
  4. To provide you with customer service, news, special offers and general information unless you have opted not to receive such information.
  5. For other purposes: We may use your information for other purposes, such as data analysis, identifying usage trends and to evaluate and improve our services, marketing and your experience.

c. How we obtain your Personal Data
We collect your personal data from the following categories of sources:
  • Directly from you. When you provide it to us directly to create an account and use the Services, or when you update the information in your account settings.
  • Automatically or indirectly from you. For example, through and as a result of your use of and access to the Services. 
  • From our service providers.
  • When you access the Services by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.
    We may also collect information that your browser sends whenever you visit our Services or when you access the Services by or through a mobile device.

d. How we share, store and protect your Personal Data
  • We don’t share the personal data we collect with someone else without your consent
  • Your personal data will be stored and/or processed on secure servers in the European Union. We follow strict security procedures in the storage and disclosure of your personal data, and to protect it against accidental loss, destruction or damage. The data you provide to us is protected using SSL (Secure Socket Layer) technology. SSL is the industry standard method of encrypting personal data and credit card details so that they can be securely transferred over the Internet.
  • We retain personal data for only as long as we need it for legitimate business purposes and a period of six (6) months after a user closes their account.

3. YOUR RIGHTS REGARDING PERSONAL DATA

You have certain rights regarding the collection and processing of personal data
  • You have the right to access, modify, and correct personal data about you, which you have full permission to do via your account Settings page.
  • You have the right to be informed about the personal data we collect and/or process about you. If you want a copy of your personal data you can send us an email and request it. See our contact information in the end of this Privacy policy.
  • You have the right to get your personal data we collected deleted from our servers, this is easiest done in your account Settings page under the Delete account section.

4. OTHER IMPORTANT INFORMATION ABOUT PERSONAL DATA AND THE SERVICES

a. Payment Information
Payments made by Artists to promote their soundtracks are processed by our third party payment providers. For example, when you make a payment that is processed by a payment provider, you will provide that third party with your credit card number, credit card expiration date, and security code, which they process and store subject to their privacy policy and terms of service. We do not receive your full credit card number, credit card expiration date, or the security code. Instead, the payment provider provides us with a “token” that represents your account, your card’s expiration date, card type and the first two and last four digits of your card number. If you are required to provide your name and email address to the payment provider, then they also provide us with that information. Payments issued to Creators for their videos are made by Viralsound using the bank account information that we have collected and stored.

b. Third-Party Websites and Services
Our Services may contain links to other websites that are not operated by us. If you click on a third party link, you will be redirected to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit as we have no control over and assume no responsibility for the content or practices of any third party sites or services.

c. Collection of Personal Data from Children
Our Services are not intended for anyone under 18. Anyone under 18 years of age is not permitted to use the Services, and we do not knowingly collect information from children under the age of 18. By using the Services, you represent that you are 18 years of age or older.

d. Business Transfer
We may share or transfer your personal data in connection with, or during negotiations of, any merger, sale of our assets, financing, or acquisition of all or a portion of our business to another company

e. Law enforcement
Under certain circumstances, we may be required to disclose your personal data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

5. COOKIES

A cookie is a small file that are placed on your computer, mobile device or any other device by a website, containing the details of your browsing history on that website among its many uses. Cookies can be “Persistent” or “Session” Cookies. Persistent Cookies remain on your personal computer or mobile device when you go offline, while Session Cookies are deleted as soon as you close your web browser.

The purpose of these cookies is to provide you with a more personal experience and to avoid you having to re-enter your preferences every time you use the website.

We may update our Privacy Policy from time to time with or without prior notice. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
